P2P litigant pleads diproportionate damges

A woman defending one of the tens of thousands of RIAA P2P lawsuits is pleading that the statuatory damages of $750 per song are disproportionate to the point of being unconstitutional. They are certainly disproportionate but she might have a hard time proving a breach of the constitution.
